Have you READ THIS YET? One of the wingnut trolls who is banned from White Noise Insanity at the moment sent a comment today (it went into the spam catcher) containing this garbage. Yep, the wingnuts think Barack Obama is not a U.S. citizen, they believe he was born in Kenya, and because Barack Obama and the DNC did not respond to the lawsuit by Phil Berg (a Hillary Clinton supporter) that asked Barack to produce his birth certificate, therefore, the wingnut neocons are now claiming Barack and the DNC have admitted to all the charges!

Bah hahahahahahaha! Oh gawd this is so funny! Bah hahaha HAHAHAHAHAHAHA!

Q: Is Barack Obama’s mother, Anne Dunham, a U.S. citizen, meaning, was she born in the United States?

A: Yes. She was born in the state of Kansas in the town of Fort Leavenworth (she was an Army brat) of the United States of America in 1942

Q: What country did Anne Dunham give birth to her son, Barack Obama, in the year of 1961?

A: Anne Dunham gave birth to Barack Obama (whose father is named BARACK OBAMA SR., was from Kenya, and who was killed in a car accident in 1982) in Hawaii, which is in the United States and in 1961, Hawaii was a state, so therefore, Anne Dunham gave birth to her son Barack on American soil.

Q: When one is an American citizen mother and one gives birth to a child in the United States of America, is the child of this mother considered an American or is the child considered a resident of the country that the father is from outside the United States?

    • Gallup: Obama 51%, McCain 45%, with a ±2% margin of error, compared to a 52%-44% Obama lead yesterday.

    • Rasmussen: Obama 52%, McCain 45%, with a ±2% margin of error, compared to a 51%-45% Obama lead from yesterday.

    • ABC/Washington Post: Obama 54%, McCain 43%, with a ±3% margin of error, unchanged from yesterday.

    • Hotline/Diageo: Obama 48%, McCain 43%, with a ±3.4% margin of error, compared to a 47%-42% Obama lead from yesterday.

    • Research 2000: Obama 51%, McCain 41%, with a ±3% margin of error, unchanged from yesterday.

    • Zogby: Obama 52%, McCain 40%, with a ±2.9% margin of error, compared to a 52%-42% Obama lead yesterday.

    Adding these polls together and weighting them by the square roots of their sample sizes, Obama is ahead 51.5%-43.1%, a lead of 8.4 points, compared to the 51.3%-43.1% Obama lead from yesterday.

    They are losing their ever loony minds and are gonna get even slimier and sicker as the last days of this campaign roll by.

    By the morning of November 5th they will be certifiable or so depressed they will need coaching to come outa mommy’s basement.

    Hopefully their mommy’s leave them down there for a while so they can grow up.

    The Annenberg Fact.Check.org has already proved that Barack Obama was born in Hawaii. You know the Palm Springs Annenbergs, the billionaire Republican best friends of Ronald and Nancy Reagan….those Annenbergs. Also the same Annenbergs who invited BOTH Barack Obama and William Ayers to sit on their prestigious education board in Chicago.

    Besides a valid birth certificate, the FactCheck group also ran down an actual Honolulu newspaper from 1961 announcing his birth on August 4.

    Barack also got his first PASSPORT when he was only six years old in order to move to Indonesia with his mother (Sarah “can see Russia from here” Palin got her first passport last year!). Probably Barack’s mother knew he was going to run for president someday so she forged his birth certificate. /snark

    Kay, I’m fairly sure that when Obama was born, citizenship didn’t pass through the maternal line but it doesn’t make any difference because Obama is automatically a citizen under Section 1 of the Fourteenth Amendment – i.e. the principle of jus soil (right of the soil): America grants citizenship to anyone born on US soil, regardless of whether their parents are citizens. The only exception is children of foreign diplomats. In Europe, it’s the complete opposite, we use jus sanguinis (right of the blood) i.e. citizenship through parentage. So I suppose I could see why some people are confused but don’t they think that McCain or Hillary might have said something by now if Obama wasn’t a citizens and therefore not eligible to run for president? lol

    Steph, Barack gets his name from his father which was Barack Hussein Obama Sr. Though his name sounds foreign, Barack’s parents were married in America. His mother was born in Kansas and his father was born in Kenya. When Barack was born to his American parents in Hawaii (they were married), he was born an American citizen.

    There are no two ways about it.

    If I married a guy right now from Honduras in America and we got pregnant and I had the baby in Honduras while on vacation, as I pointed out above via a link, as soon as the baby is born outside the country, I would have to contact American authorities in the country so my child can have American citizenship. A baby born to an American whether it’s inside the United States or outside the United States is an American.

    There is absolutely nothing to this story the neocons have created, but as Clif pointed out, the right wingers can’t win elections on their own values & morals, so they have to smear their opponent and/or steal an election. See? Losers!!!

    The question is not whether Barack is a “citizen” but whether he is, per Art. 2 Sec. 1 of the Constitution, whether he is a “natural born Citizen”. Obviously, if Sen. Obama was born in Hawaii (which I believe) this is a no-brainer. What some right-wingers have claimed (BTW, Kay this is an OLD, OLD story) is that he was born on foreign soil and that his birth certificate for Hawaii was forged. If Sen. Obama WAS born outside the country, he would not a “natural born Citizen” but instead a “naturalized citizen” based on his mother’s citizenship.

    Ironically, John McCain we KNOW WAS born outside the country, but almost all constitutional scholars agree that because his parents were on foreign soil at the service of their country AND potentially on official US soil (Foreign US bases and embassies are considered US territory as our places like Guam, for example) that he IS a “natural born citizen”.

    This whole game of trying to use the Constitution to eliminate an opponent is about as bad as those psychos on the left and right that claim that they don’t have to pay income taxes.

    Wrong, Kay. Yes, he is an American, but most constitutional lawyers would say that he or she is NOT a “natural born citizen”. In other words, an illegal immigrant’s child born in the US CAN run for president, but if you are not on official US business and have a child outside the US, he or she CANNOT run for president.

    Obama would never have received a U.S. Passport at age 6 to move from Honolulu to Jakarta if there was no birth certificate. In the case of no such certificate, the government will issue a passport based upon other sources confirming birth such as a newspaper account (which Obama also has), church baptismal/confirmation and school records that can be verified by a state agency.

    Clif, did you even bother to read what I said?! I’m not disagreeing with ya’ll. What I meant by my statement is that ANY child born in the US, under current law, is a “natural born Citizen”. US citizens that have a child born overseas is a different argument.

    The Consitution makes a very specific requirement, however, that the President must be a “natural born Citizen”, this is very clear and distinct from being a “US citizen”. If, as I believe, Sen. Obama was born in Hawaii, all this discussion is moot….

    HOWEVER, these right-wingers are claiming that Barack was born in Kenya and as such would NOT be a “natural born citizen” but instead a “naturalized citizen” once his mother filed for US citizenship.

    I AM absolutely right on this point and you are wrong!

    Why do I even bother to argue with you people, you are incapable of understanding a simple argument…. Here is the critical part of Art. 2 Section 1 of the Constitution, that has to do with the requirements for President:

    No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.

    NOTE THE DIFFERENCE between the two types of citizens… This is why Governors Schwarzenegger and Granholm (despite their popularity) cannot be on a Presidential ticket.

    Okay morons, pay attention there are only two cases that I have argued here:

    1) If Obama was born in Hawaii after Aug 21, 1959, he IS A NATURAL BORN CITIZEN. It does not matter what the heritage of his mother OR HIS FATHER is in this case. Of course, a small percentage of people on the right who believe in conspiracies (much like many people on this blog), think that Obama was born in Kenya.

    This brings us to the second case:

    2) If Barack WAS born in Kenya (again, there is no proof of this and lots of proof that he was born in Hawaii), he is NOT a natural born citizen because he was born on foreign soil AND neither parent was in the service of the government. Naturalization is generally automatic if at least one parent is a US citizen, but it’s still NATURALIZATION and not always automatic.

    Kay, JFH is right, remember you can’t restrospectively apply existing legislation, when Obama was born the Immigration and Nationality Act of 1952 was in effect and the right to natural born citizenship wasn’t based on blood right alone, his American parent had to prove habitual residence in America and he would lose it if he didn’t maintain habitual residence, which he didn’t. But it’s all academic because Obama is a natural born citizen because he was born in the USA and the law of jus soli grants him that right.

    Barack Obama was born in 1961 in Hawaii. His mother and father (Anne Dunham & Barack Hussein Obama Sr.) were legally married in the United States. Anne was born in Kansas and is a naturally born citizen and Barack Sr. was born in Kenya and was not. But, they both were citizens of the United States when Barack was born. Two years after Barack’s birth, Anne and Barack Sr. divorced and he went back to Kenya.

    Why is this so confusing for some here? It’s very simple.

    Read my posts… NO ONE has a case if Obama was born in Hawaii after Hawaii was a state (BTW, the difference between Barack’s birth and statehood is less than 2 years not 11 years)… AND EVEN if he was born before Aug 21, 1959 it falls into that gray area of being a US territory.

    His mother’s citizenship (or his father’s citizenship) is inconsequential when it comes to a “natural born citizen”. It is almost universally accepted that diplomats and military personnel assigned overseas that the “natural born citizen” applies to their children, BUT most scholars agree that children born to US citizens abroad are “naturalized citizens”.

    Kay, you and Clif, read into my comments what you want to read… Reread them assuming they were coming from, say, Steph, and see if anything I wrote was wrong.

    I got the distinct feeling that you were making the argument that any US natural born citizen can give birth to a natural born citizen in dependent of the birth location. THIS IS NOT TRUE, in my opinion… do you disagree with me?

    Kay, JFH is right. Obama is a natural born citizen because he was born in Hawaii, he had a theoretical claim to being a natural born citizen through his mother’s citizenship if he was born outside the USA, but that would have been conditional and disputable. But Obama was born in Hawaii and is a natural born citizen.

    I can see why people might have questioned his citizenship at the beginning of his campaign, but not now. It seems more like a desperate smear attempt but when the bookies have already begun paying out, you know the race has already been won.

    Actually, the comment (in defense of John McCain’s birth status) above inside my comment #41 says a person born to an American anywhere on the planet is a naturally born citizen. Now, if a woman is here in America from Kenya and is not an American but gives birth while here, her child is naturally born citizen of America….that is if she wants her child to have America on the child’s birth certificate. She could opt to have her native country as her child’s citizenship.

    Exactly right, as I said before, this is OLD, OLD news and has been thoroughly debunked.

    Kay, the only place we have a dispute is whether a child born on foreign soil to a US citizen is a natural born citizen… I say that he/she is not, yet (I think) you believe he/she is… I think the general consensus is on my side but like any constitutional question, I could be “wrong”.
